I was just wondering if I buy an iphone off of ebay or craigslist, will I have to buy the data plan?

I have downloaded an application called PdaNet for my Motorola Droid and I can use it to tether the 3G internet from Verizon to my computer when I do not have WiFi access. The application itself was free but I don’t know if Verizon would charge me for tethering my phone to my computer.
